Will of Joseph Burke from Newfoundland will books volume 14 pages 330-331 probate year 1928

In re       DECEASED.
      JOSEPH BURKE.

I JOSEPH BURKE of Bay Bulls Nfld. Fisherman do make publish and declare this as my last will and testament hereby revoking all other and former wills.
I appoint VINCENT P. BURKE ESQUIRE os St. John's Nfld. and THOMAS G. WILLIAMS ESQUIRE of Bay Bulls Nfld. to be the executors of this my will directing them after my death to pay all my just debts, funeral and testamentary expenses.

  1. I give devise and bequeath all that piece or parcel of land with dwelling and barn thereon situated on the South Side of Bay Bulls and bounded as follows; on the North East by Main Public Road, on the North by land in the possession of Emily O'Brien running on this boundary to the North end of said dwelling, and continuing from North end of dwelling for three feet, thence continuing in a Westerly direction for sixty feet, then cutting South West at about right angles, and continuing for forty feet to meet land in the possession of Jeremiah Williams and running with this said land of Jeremiah Williams as a boundary to the Main Public Road, to my wife Julia Burke during her lifetime, and upon the death of my wife Julia Burke and aforementioned land and erections thereon to go to my Grandchild Robert G. Williams.
  2. I give devise and bequeath to my wife Julia Burke during her lifetime and after her death to my Grandchild Robert G. Williams; all that piece or parcel of land situated at Bay Bulls and being my water front property and bounded as follows; on the west by main road on the North West by drain which separates it from land in the possession of Emily O'Brien running thence by land belonging to Stephen Williams, which forms its North West boundary, thence to the waters of the Harbour, bounded on the East by the waters of the Harbour, and on the South East and South by land in the possession of Jeremiah Williams and running to the Main Road, A Road known as the lower road runs through the water side section of this land.
  3. I give devise and bequeath to my wife Julia Burke during her lifetime and after her death to my Grandchild Robert G. Williams; all that piece or parcel of land with Barn thereon situated on St. John's Road Bay Bulls and bounded as follows; on the North East by Main Public Road, on the South West by Main River, on the South East by land belonging to one Patrick Williams, and on the North West by land in the possession of said Patrick Williams and one Michael O'Driscoll.
  4. I give devise and bequeath to my nephew Anthony O'Brien; all that piece or parcel of land situated at Bay Bulls and bounded as follows; on the North West by land in the possession of one Cornelius Glynn on the West by the road known as the Lower Path, on the East, North East, and North by the Main Public Road for his sole use and benefit.
  5. I give devise and bequeath to my wife Julia Burke all my household furniture and effects for her sole use and benefit.
  6. I give devise and bequeath to my wife Julia Burke my portion of the 100 shares held by me and numbered from 27067 to 27166 in the United Towns Electric Co. for her sole use and benefit.
  7. I give devise and bequeath to my wife Julia Burke my share of the money with interest thereon in the Royal Bank Canada for her sole use and benefit.
  8. If my Grandchild Robert G. Williams should die without children surviving him and at his death my Nephew Anthony O'Brien should be living or should any children of my Nephew Anthony O'Brien be living, then any of the aforementioned land and property as described and outlined and remaining to go to my Nephew Anthony O'Brien or his children.
  9. Upon the death of my wife any bequests or portions thereof under sections 5, 6, 7, of this my will and which still be remaining to be divided equally between my Grandchild Robert G. Williams, my Nephew Anthony O'Brien and my sister Emily O'Brien.
  10. I direct my executors if at any time it may be required for the maintenance of my wife Julia Burke to sell all or any portion of the land and property outlined in sections 1, 2, 3, of this my will.
  11. The rest residue and remainder of all or any property etc. of which I may die possessed I give devise and bequeath to my wife for her sole use and benefit.

In witness whereof I have hereunto subscribed my hand and seal at Bay Bulls this 15th, Day of May Anno Domini one thousand nine hundred and twenty eight.

Signed published and declared by the said testator as and for his last will and testament in our presence who in his presence and at his request and in the presence of one another have hereunto subscribed our hands as witnesses.
