In re
Samuel Brown deceased.
In the name of God, Amen. I Samuel
Brown, Senior, of Kings Cove Bonavista Bay in the Island of Newfoundland,
being of sound mind memory and understanding do make this my last will and
Testament. I give and bequeath unto my wife Ann Brown my new Shop and Waterside,
situate on the north side of King’s Cove to be disposed of by her at
any time after my death as she may deem fit: I also give to my said wife the
sum of Four Hundred and Eighty one Dollars and Forty Three cents, money deposited
in my name in the Newfoundland Savings Bank. I give and bequeath all the real
and personal estate I own or shall or may be entitled to at the time of my
death except as before and hereafter mentioned unto my said wife Ann
Brown to have and to hold the same unto her for and during her natural
life and upon her death I will and bequeath my estate as follows:
To my adopted
son and nephew Samuel J. S. Brown I bequeath my Dwelling House with contents
of same with Land and Meadows alongside and nearby with all Buildings and Erections
thereon as used by me during my lifetime, also my meadow near the Pond, known
as Wicks’ Meadow and my Two Gardens situate on the Road to Plate Cove,
one bought from Frederick Handcock and one bought from Tom
Coffin; also that
piece and parcel of Land situate on the Road to Plate Cove, and known as the
Farm, with Hay house erected thereon. I also give and bequeath to my said nephew
Samuel J.S. Brown one half of garden situate at the back of Stephen
Brown’s
House, the other half or Eastern part of said Garden I give and bequeath unto
my nephew Stephen Brown son of my brother James Brown.
I give and bequeath to my two nephews Samuel J. S. Brown and Edwin
Brown in
equal shares all my right title and interest in and to “Browns” Fishing Room
also my stock in trade, Boats, nets and everything I own in connection with
my business (New Ship excepted) subject to the following conditions, that is,
that they the said Samuel J. S. Brown, and Edwin Brown shall assume and pay
all and any debts that I may owe at the time of my death, and that they contribute
toward the support of my wife, Ann Brown, either by paying a stipulated rental
for my new shop or in other ways as may be agreed upon between them and my
said wife. The contents of my Fish Store, I give and bequeath to my nephews
Samuel J. S. Brown and Edwin brown in equal
parts.
I give and bequeath to my two nephews Stephen Brown and Eric
Brown,
my old shop with kerosine House and fish flake at back of same half to each.
I give and bequeath to my two nephews Eric Brown and Kenneth
Brown, my meadow
situate on the west side of Road leading to Cannons Wall
The one thousand dollar
bond of the Canada Machinery Corporation I own, I give and bequeath as follows:
- One hundred and fifty dollars each to Samuel J. S. Brown and Edwin
Brown;
one hundred dollars each to my bothers James Brown and Norman
Brown and one
hundred dollars each to my nephews Eric Brown, Stephen Brown Kenneth
Brown and John Brown and fifty dollars each to Norman
John Brown and Chester Brown
Sons respectively of Samuel J. S. Brown and Edwin
Brown; in the event of said
Thousand Dollar Bond not realizing face value if sold, the loss on same is
to be borne proportionately by each legatee. And I hereby appoint Samuel
J. S. Brown and Edwin Brown Executors of this my
last will and Testament. In Witness whereof I the said Samuel
Brown Senior have hereunto set my hand this twenty eight day of September A.D. one thousand
nine hundred and thirteen Samuel Brown Sr (LS). Signed by the above Samuel
Brown Senior, this his last will and Testament, in the presence of us, both
being present at the same time, who in his presence, at his request and in
the presence of each other, have signed our names as witnesses John
G. Hart,
Aubrey Brown.
