Will of Benjamin Brake from Newfoundland will books volume 15 page 521 probate year 1931

IN RE                    DECEASED.
Benjamin Brake
.

Know all men,

     Testament of Benjamin Brake, of Middle Arm, Bay of Islands, District of St. George's
     This is the last will and testament of me Benjamin Brake of Middle Arm, aforesaid.
1st. I appoint my two sons, James Brake and Thomas Brake, to be my executors of this my will, and I declare that the words used shall comprise the persons aforesaid named, and the survivor of them to be the executor of this my will.
2nd. I give and bequeath and devise my estate as follows; I will and desire that all my just debts be paid out of my estate.
3rd. I will and desire that my beloved wife Ellen Brake shall have the control of my dwelling house, with all my household furniture and household effects during her life time.
4th. I will and devise and bequeath all my estate of every description save and except whatever money at the time of my death, stores, land outhouses, boats, net, horse, cows and all other property I shall be possessed of at the time of my decease, shall be equally divided between my four sons, namely, James Brake, Thomas Brake, John Brake, and Ralph Brake, or the survivor of them, with the understanding that my beloved wife Ellen Brake shall be provided for by my said sons out of my said estate, a yearly allowance for her comfort during her life time.
5th. I will devise and bequeath to my beloved wife Ellen Brake, and my two sons Thomas Brake and Ralph Brake, all the money that I may die possessed of to be divided equally between them. Should any portion of my wife Ellen Brake's share be expended at her death, that she shall divide it amongst our children as she may think fit.
6th. I will and desire that my unmarried daughters shall have a peaceable residence in the household, as long as they conduct themselves in a proper and obedient manner to their Mother and Brothers.
7th. I direct and desire that my executors or either of them will carry into effect the foregoing sections of this my last will and testament.
In witness whereof I have hereunto set my hand and seal. This 21st day of December in the year of Our Lord One Thousand Nine Hundred and Six.
Signed by the said Benjamin Brake in the presence of us present at the same time, who in his presence, and in the presence of each other, subscribed our names as witnesses,
