In re JAMES BINGHAM       DECEASED

This is the last Will and Testament of James Bingham of Fortune Harbor, in the Island of Newfoundland, retired. I, James Bingham being of sound disposing mind memory and understanding do hereby will devise and bequeath as follows:

  1. Unto my adopted son Patrick Lane all the land that I own and possess situate and being in Fortune Harbor together with all erections thereon, including dwelling house and furniture of every description as well as all other houses and stores, provided nevertheless that my wife Ann must and shall remain in the dwelling house during her natural lifetime.
  2. Unto my wife Ann the sum of Four hundred dollars.
  3. Unto my brother John Bingham of Carbonear the sum of Two hundred dollars.
  4. Unto my adopted son Patrick Lane the sum of Seven hundred dollars.
  5. Unto my sister Agnes Guest of Carbonear the sum of One hundred dollars.
  6. Unto my sister Frances Harrington of Carbonear the sum of Fifty dollars.
  7. Unto my sister Mary McGrath of Carbonear the sum of Fifty dollars.
  8. Unto James Lane, son of Patrick my watch.
  9. After my funeral and testamentary expenses are paid I leave and bequeath the balance of my estate to Bessie Lane and James Lane wife and son of Patrick respectively, share and share alike. I nominate and appoint John Hamilton and William Quirk both of Fortune Harbor aforesaid as the Executors of this my last Will and Testament. I revoke all wills or former distributing of my aforesaid property and do declare this to be my last Will and Testament.

In witness whereof I have signed my name at Fortune Harbor aforesaid on this Twenty first day of September in the year of Our Lord One thousand nine hundred and twenty one. JAS BINGHAM.
Signed Published and Declared by James Bingham the Testator in our presence, who in his presence and in the presence of each other, at his request, at the same time signed our names as witnesses. WILLIAM QUIRK.    I.J. MIFFLEN of Twillingate.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
