Will of Samuel Billiard Senior

Last Will and Testament of
Samuel Billiard Sr. late of
Grand Bruit, Burgeo LaPoile, Planter

      In the name of God Amen. This is the last will and Testament of me Samuel Billiard Senior, of Grand Bruit, in the Electoral District of Burgeo and LaPoile, in the Southern District of the Island of Newfoundland, Planter. I appoint my son, Samuel Billiard, of Grand Bruit, and Rev. Eugene Forsey of Petites, in the Electoral District of Burgeo and LaPoile, Newfoundland, executors hereof.
First I direct that none of the money left by me at my death is to be divided or distributed until the death of my beloved wife, Sarah Billiard, should she survive me. In such case (i.e. should she survive me) no legacy hereafter mentioned is to be paid until her death, if such legacy be a sum of money.
2 My beloved wife Sarah Billiard is to have all ready money left by me at the time of my death, whether invested or on hand; I give and bequeath to her, my wife, Sarah Billiard, all such to be used by her as need requires. In the event of her death before my own, the division and distribution of my money is to be made as hereinafter provided, as soon as practicable after my death.
3 I give and bequeath to my beloved son John Billiard, the sum of Four hundred dollars currency subject to the provisions aforesaid; which legacy is to be the first claim to be paid at the time of the distribution of my money as aforesaid. This legacy to be paid my beloved son, John Billiard, aforesaid, over and above his share of property and money as hereinafter mentioned.
4 I do give and bequeath to my beloved sons John Billiard and Samuel Billiard the whole of my salmon fishing gear to be divided equally between them at my death.
5 I give bequeath and devise my dwelling house (with furniture belonging to me at my death) my store house adjoining the said dwelling house with the ground on which they stand with its appurtenances to my beloved son John Billiard.
6 I give and devise my stage flake, and fish house to my beloved sons Samuel Billiard, William Billiard and John Billiard
7 I give and bequeath to my beloved son John Billiard all my right title and interest in the stores adjoining the stage; with this provision that as long as the seed store stand he is to let my beloved sons Samuel Billiard and William Billiard have the use of a part of them should they so require.
8 I give and devise to my beloved sons Gabriel Billiard, Robert Billiard, Martin Billiard, Samuel Billiard & William Billiard all my right title and interest in the land upon which their houses and outhouses stand with surroundings
9 At the time of the division and distribution of my money according to provision of paragraph number "two" in the margin, I do direct that after the payments of legacy aforementioned to my son John Billiard, my money remaining is to be divided with nine equal parts. Of these, I do give and bequeath to my beloved son, Gabriel Billiard one part, to my beloved son Robert Billiard, one part; to my beloved daughter Miriam Childs, one part; to my beloved son Martin Billiard, one part; to my beloved daughter Hannah Collier, one part; to my beloved daughter Martha Courtney one part; to my beloved son Samuel Billiard one part; to my beloved son William Billiard one part and to my beloved son John Billiard one part.
And I hereby revoke all previous wills by me at any time heretofore made and declare this writing to be my last will and Testament. In witness whereof I hereunto set my hand this fourth day of December, in the year of our Lord one thousand eight hundred and ninety four. Samuel his x mark Billiard Sr. Signed by the said Samuel Billiard Senior the Testator in the presence of us, who in his presence and in the presence of each other at the same time subscribe our names as witnesses
