Will of Leah Mary Bennett
from Newfoundland will books volume 9 pages 141-145 probate year 1910

In re
      Leah Mary Bennett          deceased.

      This is the last will and Testament of me Leah Mary Bennett of Layton Cotham Grove in the City of Bristol Spinster whereby I revoke all former wills and testament any dispositions made by me
I bequeath the following pecuniary legacies free of legacy duty namely to my nephews Robert Ehlers and Ernest Herman Ehlers and to my friend Percy Baldwin of Bristol Solicitor and to my faithful servant Catherine Bloodsworth the sum of Ten pounds each and to each of the children of my niece Ida Isabella Lingford who shall be living at my decease the sum of fifty pounds
I give the following specific bequests To my sister Rosa Eliza Tessier Bennett my old china potpourri dish and stand to my said nephew Ernest Herman Ehlers one large silver gravy spoon six large silver forks six small silver forks six silver dessert spoons six silver table spoons one silver gravy ladle one silver soup ladle two silver salt spoons six small silver teaspoons and the furniture and contents of the dining room at “Layton” except the Clock
To my said nephew Robert Ehlers one large silver gravy spoon twelve large silver forks twelve small silver forks twelve silver dessert spoons twelve silver table spoons two silver gravy ladles and two silver salt spoons
To my niece Alma Lees my pair of Sheffield plate Candle sticks in the drawing room
To the said Catherine Bloodsworth my dining room clock and the bed bedding and furniture in my own bedroom with the exception of the pictures
To my said niece Ida Isabella Lingford the Sheffield plate Candelabra and one Candlestick in the drawing room my plated tea pot coffee pot milk jug and sugar basin plated entree dish small plated salver the furniture and contents of the spare bedroom and studio at “Layton” my household linen and the remainder of my clothing furniture and household effects

I give devise and bequeath the residue of my estate whatsoever and wheresoever to the said Robert Ehlers and Ernest Herman Ehlers (hereinafter called “my Trustees”) Upon trust as soon as conveniently may be after my decease to pay and divide the same equally between such of the following persons as shall be living at my decease namely my nephews and nieces Ernest Herman Ehlers Ida Isabella Lingford Robert Ehlers Thekla Cornford Charles Frederick Ehlers and Alma Lees wife of Edwin Leonard Lees (the children of my late sister Elizabeth Ehlers) and if any of my said nephews and nieces shall die in my lifetime leaving issue any of whom shall be living at my death such issue living at my death shall take equally amongst them if more than one the share which their respective parents would have taken if living at my death But as to the share of the said Ida Isabella Lingford I bequeath the same to my Trustees Upon trust that they shall either retain the same or any part thereof in the state of investment in which the same may be at my decease I hereby declaring that they shall not incur any responsibility by so doing or shall at their discretion sell and convert the same into money and shall invest the proceeds of such sale and conversion in their or his names or name or under their or his legal control in any of the public stocks or funds or Government securities of the United Kingdom or India or any Colony or Dependency of the United Kingdom or upon real securities in England or Wales or in or upon the stocks funds shares debentures mortgages or securities of any Corporation Company or public Body Municipal Local Commercial or otherwise in the United Kingdom or India or any Colony or dependency of the United Kingdom and paying a dividend upon its ordinary stock or shares at the time of making such investment and may from time to time vary such investments for others of any kind hereby authorised and shall pay the income of the same and the investments for the time being representing the same to my said niece Ida Isabella Lingford during her life for her sole and separate use and from and after her decease shall hold one half of the said share and the income thereof in trust for her son my great nephew George Kenneth Lingford absolutely to be paid to him upon his attaining the age of twenty one years. But in case he shall die before he attains the age of twenty one years then the same shall be held in trust for such of the remaining children of the said Ida Isabella Lingford living at my decease as shall attain the age of twenty one years And as to the other half of the said share In trust for such of the remaining children of the said Ida Isabella Lingford living at my decease as shall attain the age of twenty one years in equal shares But if none of the children of the said Ida Isabella Lingford living at the decease shall attain the age of twenty one years then In trust for and equally between such of my said nephews and nieces Ernest Herman Ehlers Robert Ehlers Thekla Comford Charles Frederick Ehlers and Alma Lees as shall be living at the decease of the last surviving child of the said Ida Isabella Lingford

and whereas on the twenty fifth day of March one thousand nine hundred and two I lent the sum of six hundred pounds to my said nephew Charles Frederick Ehlers he paying interest to me for the same after the rate of five per cent per annum now I hereby declare that the said sum of six hundred pounds so as aforesaid lent to my said nephew Charles Frederick Ehlers or such part thereof as may be owing at the date of my decease together with any interest upon the said sum of six hundred pounds or such portion thereof as may be unpaid at the date of my decease shall be taken by him in part satisfaction of his share under this my will and accordingly that my said residuary estate shall be divided between the persons among whom the same is directed to be divided as aforesaid in such manner that the share of the said Charles Frederick Ehlers shall be less in amount then the share of the other children by the sum of Six hundred pounds or such part thereof as may be unpaid at the date of my decease together with any interest if any at the rate aforesaid remaining unpaid up to the date of my decease    Lastly I appoint the said Robert Ehlers and Ernest Herman Ehlers Executors of this my will In witness whereof I have hereunto set my hand this twenty eighth day of September one thousand nine hundred and nine    L. M. Bennett     Signed by the before named Leah Mary Bennett as and for her last will and Testament in the presence of us both present at the same time who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses -
