John Bond Bennett

 

Will of John Bond Bennett from Newfoundland will books volume 5 pages 277-278 probate year 1888.
This will is also recorded on page 229 in this volume. The wills are similar, with only a few minor differences, and the comments of the registrar.

Last will and Testament of John
Bond Bennett late of Fogo, Planter Deceased.

I John Bond Bennett of North Side Fogo, do hereby make my last will and Testament. In the first place, I desire that an amt of seventy pounds with its interest now lodged in the St. John's Saving Bank, remain there for the use of my family my executors having the power to draw out ten pounds thereof annually, which is to be handed to my wife and children for their joint maintenance.
Next I desire that all my household furniture and chattel remain until my son comes of age in care of my wife as hitherto, provided she retains her present name, but that as regards right title etc in the house my son John Henry Bennett shall claim one bedstead, bed, and bedding, my two guns clock and watch, carpenters tools, also small fishing gear lines etc and such other household furniture as are not herein expressly named as having been otherwise distributed.
To my daughter on her coming of age one bedstead, bed and bedding also my large Bible.
I desire that my half of the dwelling house in which we have resided become the property of my aforesaid son John Henry Bennett. That the third part of the Fishing Room also become the property of my aforesaid son. that my third of all fronted fishing gear such as boats, nets, traps, and all other (excepting schooner & caplin seine which are otherwise provided for) be realized and sold by my executors for the benefit of my son aforesaid and to the payment of any just debts which I may have incurred.
I further devise that the schooner held by me remain in the use of my surviving brothers until she be worn out or sold. On condition that my said brothers shall keep the whole room in good repair and provide wood for the house, as well for my family as their own, and if the said schooner be sold that my son aforesaid shall receive one third of the proceeds. I further desire that one third of the value of my caplin seine be paid at once to my executors for the benefit of my son. In order that this will and desire be fully carried out I hereby appoint Henry John Earle (Merchant) and Henry Bennett my eldest brother, both of Fogo, my executors charging them to see that all things are in accordance with both letter and spirit of this Testament. In witness whereof I have set my hand and seal this fourth day of June in the year of our Lord 1887.
