from Newfoundland will books volume 9 pages 493-494 probate year 1912

In re
      James Bennett          deceased.

      In the name of God Amen I James Bennett of Holyrood being very weak but in perfect mind and memory and knowing that it is appointed for all men once to die to make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul into the hand of Almighty God that Gave it and my body I commend to the earth to be buried in decent Christian burial at the discretion of my executors nothing doubting but at the General resurrection I shall receive the same again by the mighty power of god and as touching such worldly estate wherewith it hath pleased God to bless me in this life I give devise and dispose of the same in the following manner and form.
First I give to my son Mike all the land I possess out side and House and out Houses my Bed is to be Miks and if he don’t return to live on the place the bed is to be sold for Masses for my self and wife The Cars is to be Mikes’ and James is to have the use of them untill Mike want them. My son James can’t claim no land out side of my fence that is to say to the south west of his House. My son John can’t claim nothing out side but his Kitchen garden, my son Mike is to have that parcel of clear land by the Broad Brook on Wittless Bay line Bounded by John on the south that parcel of land bounded by John on the north and James on the south shall be Divided between Mike and Petter if William Don’t come home my son James is next the south plot of land. Frank shall have that plot of land on the Wittless Bay line Bounded by Mike on the south and one mile on the north and Mike is to have from one mile to wooden Bridge.
Kate is to have my Cow and if she sell the Cow the money is to be turned into a head stone. James is to have the use of the out side land untill Mike come back. This is my last will and Testament in witness whereof I have set my hand and seal this 21 day of January in the year of our Lord one thousand nine hundred and seven. I also appoint W. P. Walsh as my executor Signed by the said James Bennett as his last will and testament in the presence of each other have hereunto subscribed our names as - James his x mark Bennett - witness Michael Dunphy John x Mullowney
