Will of Nicholas Batterton

Last Will and Testament of
Nicholas Batterton of Greenspond
Cooper deceased.

      Greenspond 27th March 1894.
The last will and Testament of Nicholas Batterton Pond Head, Greenspond Bonavista Bay in the norther District of the Island of Newfoundland. I Nicholas Batterton considering the uncertainty of this mortal life and being of sound mind and memory do make and publish this my last will and Testament.

Firstly I order my executor to give my body a decent Christian burial and erect a headstone on my grave, with appropriate inscription for my wife and myself. The funeral expenses and headstone are to be paid out of the money I leave. The remainder of my money after paying for the funeral expenses and headstone I give and bequeath to my daughter Annie Maria Batterton

Secondly. I give and bequeath unto my son Phillip Batterton and my daughters Katherine Howard and Annie Maria Batterton all and singular all the land and all the property thereon I own in Pond Head to be equally divided among them to remain to the said Phillip Batterton, Catherine Howard and Annie Batterton their heirs executors and administrators for ever. Neither the said Phillip Batterton nor Anne Maria Batterton nor Catherine Howard can sell his or her share individually without the unanimous consent of the three parties concerned

Thirdly. Should my son James Batterton desire at any time to come and live in Greenspond Phillip Batterton Annie Maria Batterton and Catherine Howard are to give him an equal share of the land and property in Pond Head during James Batterton's life time. In the event of James Battertons decease his heirs are not to have any claim on the property.

Lastly I hereby appoint and nominate John MacDonald, Physician and Surgeon to be the sole executor of this my last will and Testament, revoking all former wills by me at any time heretofore made (sgd) Nicholas Batterton (LS) Witness my hand and seal at Greenspond this twenty seventh day of March in the year of our Lord one thousand eight hundred and ninety four. The above instrument consisting of one sheet was now here subscribed by Nicholas Batterton the Testator in the presence of each of us and was at the same time declared by him to be his last will and Testament, and we at his request sign our names hereto as attesting witnesses (sgd) George Burry (LS) (Sgd) Stephen Burry (LS) Greenspond 27 Mar. 1894

      I certify the foregoing to be a correct copy of the last will and Testament of Nicholas Batterton deceased
