Last will and Testament
of James Barnes of Topsail
Conception Bay Farmer

In the name of God Amen. I James Barnes of Topsail Conception Bay in the Island of Newfoundland Farmer being very sick and weak but of perfect mind and memory and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament. That is to say principally and first of all I give and recommend my soul into the Hand of Almighty God that gave it and my body I commend to the earth to be buried in decent Christian burial according to the rites of the Church of England nothing doubting but at the General Resurrection I shall receive the same again by the mighty power of God.
And as touching such worldly estate wherewith it hath pleased God to bess me in this life I give devise and dispose of the same in the following manner and form. First I give and bequeath to my dearly beloved wife all my land on the north side of the Lane, called Barnes Lane at Topsail to be at her free and full disposal to sell the same when she may think proper; but if any of my brothers wish to purchase said Land he shall have the chance to purchase it, if they will give as much for it as is offered by any other person. Also I give and bequeath to my beloved wife my share of land given me by my father, John Barnes on which my house stands, also my house and all household furniture to be held and enjoyed by her while she remains a widow; but if she marries again she has no further claim upon this said piece of land, if she remains a widow she shall enjoy and live upon the same if she wishes to do so, or shall be at liberty to rent this said land and house during her life but if my brothers, or either one of them are willing to buy my house and this said piece of land from my wife at any time before her death they shall be permitted to do so.
Lastly I appoint John Jennings Butler of Topsail to be my executor of this my last will and Testament - In witness whereof I have hereunto set my hand and seal this tenth day of April in the year of our Lord, one thousand eight hundred and eighty Five - James his x mark Barnes (LS) Signed sealed published pronounced and declared by the said James Barnes as his last will and Testament in the presence of us who in his presence and in the presence of each other have hereunto subscribed our names as witnesses - William Swansborough - John Jennings Butler -
