Will of Archibald Banks
from Newfoundland will books volume 12 page 52 probate year 1921

In re
     ARCHIBALD BANKS.      DECEASED.

This is the last Will and Testament of Archibald Banks, Planter of Fogo in the Northern District of Newfoundland. I, Archibald Banks considering the uncertainty of this mortal life, and being of sound mind and memory, do hereby make this my last Will and Testament in manner and form following, that is to say.

  • FIRST. I give and bequeath to Charles Chaffey, son of my second Wife Isabella Chaffey, all my right right and title to real Estate and Fishing Property situated at Back Cove Fogo, that is to say Gardens, Stage, Flakes, Stores and Dwelling House with Furniture, also all my Fishing Gear whatsoever, Boats, Motor, Trap, Guns, and Nets, and everything connected with the Fishery.
  • SECONDLY. I give and bequeath to Allen Coles son of Jonas Coles, the sum of Six Hundred Dollars.
  • THIRDLY. I give and bequeath to my brother Nathaniel Banks or his Wife Harriet Banks whichever may be living at the time of my death, the sum of One Hundred Dollars.
  • FOURTHLY. I give and bequeath to St. Andrews Church Fogo, a Brass Lectern as a memorial, same to be purchased by the Rector at his discretion.
  • FIFTHLY. After all my just and lawful debts are paid, I give and bequeath to Charles Chaffey son of Isabella Chaffey, all the residue of my money due me at the Bank of Nova Scotia Fogo, or on Merchants Books, after all the foregoing sums are paid.
  • LASTLY. I revoke all former wills made by me, and declare this to be my last will and Testament, and I appoint Ernest E. Hyde Manager, as my Executor thereof.

In witness whereof thereunto set my hand at Fogo, this thirtyth day of September in the year of our Lord, One thousand nine hundred and Nineteen. ARCHIBALD BANKS
Signed by the said Archibald Banks the Testator, in the presence of us who in his presence and in the presence of each other at the same time subscribe our names as Witnesses. ALLAN COLE     STANLEY LAYMAN.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
