Last will and testament
of Margaret Baird
of St. John's widow Deceased
.

This is the last will and testament of me Margaret Baird of St. John's widow of the late David Baird. 1st I hereby revoke and declare void all wills and testaments heretofore made by me and declare this to be my last will and testament.
2nd. I bequeath to my grandson David Harvey Monroe Baird one share in the Commercial Bank of Newfoundland at present held by James Goodfellow Esquire Trustee. 3rd I bequeath to my grandson John Boyd Baird one share in the Commercial Bank held in similar manner by said James Goodfellow.
Fourth. I bequeath to my granddaughter Margaret Mary Baird daughter of my daughter Annie Sclater one share in the Commercial Bank held in similar manner by James Goodfellow.
Fifth To my children Maggie Firth Annie Boyd Sclater, Jessie Baird Mary Baird Selina Baird Isabella Baird and David Anderson Baird I bequeath each one share in the Commercial Bank, held in manner aforesaid, such share to be held by my daughters free and independent of the control of any husband that they may marry
Sixth the whole of my household furniture whether in the Country House or the house now occupied by me in town, or any houses, in which I may live together with all linen wearing apparel, pictures ornaments of all kinds and all other contents of the said house or houses I bequeath to those of my daughters (if any) as may be unmarried at the time of my decease but it is my will and desire that if the whole of my daughters should marry then and in such case the household furniture and all the above mentioned property shall be sold by public auction and the proceeds of such sale shall be distributed amongst the children mentioned in the fifth section of this my will share and share alike, the children of a deceased child to take the parents share also share and share alike.
Seventh. The whole of the balance of my estate with the exception of the farm and Country house including all moneys that may be to my credit or the credit of my trustee in any Bank in Newfoundland or elsewhere and all moneys that may be invested for me and whether the same shall be invested in my name or otherwise I bequeath share and share alike to the children mentioned in the fifth section of this my will namely; Maggie Firth Annie Boyd Sclater Jessie Baird Mary Baird Selina Baird Isabella Baird and David Anderson Baird the children of a deceased child to take the deceased parents share, share and share alike provided that the bequest mentioned in this section and all other bequests made to my daughters under this instrument shall be free and independent of the control of any husband they may marry.
Eighth. If by reason of failure in business or any other cause my son John A. W. Baird should make default in the payment of the sum of two hundred pounds which he has agreed to pay to me annually and to my unmarried daughter or daughters in the event of my death it is my desire that my executors before the payment of any legacies shall invest a sufficient sum to pay to my unmarried daughter or daughters each the sum of fifty pounds annually until coverture or death, provided however that not more than one hundred pounds shall be thus paid and no greater sum shall be invested that shall be found sufficient to return an income of one hundred pounds annually notwithstanding that more than two of my daughters may be unmarried at the time of the default mentioned in this section.
Ninth. It is my will and desire that before any legacies under the terms of this instrument are paid a sufficient amount shall be invested to insure to my daughter Mary an annual income of fifty pounds.
Tenth. It is my will that the country house and farm shall be sold as soon after my decease as shall be found practicable and the proceeds of such sale shall be divided share and share alike between the children mentioned in the fifth and seventh sections of this will and their children in the event of the death of a parent leaving lawful issue provided however that the provisions of this section shall be subject to the conditions of an agreement which is to be hereafter entered into between my son David Anderson Baird and myself in relation to the said country house and farm.
Eleventh. In the event of the death of any of the children mentioned in the fifth and seventh sections of this will without leaving lawful issue then the share or interest of such child or children under the provisions thereof shall be distributed equally between the survivors of them and their children.
Twelfth. The principal sum invested under the provisions of the ninth section of this my will may be disposed of by my daughter Mary by last will or declaration of trust. Provided only that the said principal sum shall remain intact during her lifetime.
Thirteenth. If it should be necessary to invest any moneys under the provisions of the eighth section of my will it is my desire that upon the marriage or death of the daughter or daughters referred to therein the moneys so invested shall become part of my general estate and shall be subject to the provision of the seventh section of this my last will.
Fourteenth. I appoint my son David Andersen Baird and my daughter Mary Baird as executors of this my last will Margaret Baird Signed published and declared as and for the last will and testament of the said Margaret Baird who in our presence signed the same J. Goodfellow J. R. McNeily
As a codicil to this my last will and testament while confirming in all other respects my said will. The second third and fourth sections of my said will I hereby cancel and declare void and the fifth section so far as it refers to Maggie Firth I also declare to be cancelled and made void and it is my desire that the shares in the Commercial Bank bequeathed respectively to my grandchildren David Henry Monroe Baird Margaret Mary Baird and to my daughter Maggie Firth shall be and become after my decease the property share and share alike of my unmarried daughters or daughter, but if all my daughters should be married then the said shares shall be divided amongst all my daughters share and share alike. Margaret Baird Signed published and declared in the presence of us who in the presence of the testatrix and of each other witnessed the same J. Goodfellow J. A. McNeily.
