In re Jessie Ayre       deceased

This is the last Will and Testament of me Jessie Ayre [formerly Jessie Eales] of St. John's in the Island of Newfoundland Widow.

First. I nominate and appoint James Lester of St. John's aforesaid. Farmer, as sole Executor of this my said last Will and Testament.

Second. I give devise and bequeath to the said James Lester all and singular whatsoever lands chattels monies and effects that I may die possessed of to hold the same upon trust and to pay the rents issues and profits arising therefrom to my sister Emma Cole Eales during the term of her natural life.

Third. After the death of my said sister, Emma Cole Eales I give devise and bequeath my one half undivided interest, in the land on Cockpit Road known as Richmond Hill, bequeathed to me and my said sister under the will of my late father in the following manner that is to say- To my niece Mary Elizabeth Ann Clouston one fifth part. To my niece Emma Cole Eales Davidson one fifth part. To Charles F. Lester one fifth part. To Mary Louise Dunn one fifth part, and to the said James Lester one fifth part-the said Mary Elizabeth Ann Clouston and the said Emma Coles Eales Davidson to have that portion or part of the said land upon which their respective houses are now built-the said Charles F. Lester to have that portion or fifth part adjoining Sclaters land the said Mary Louisa Dunn to have that portion or fifth part immediately West of the said Charles F. Lesters and the said James Lester to have that portion or fifth part immediately West of the said Mary Louisa Dunns portion, each of the said lots or portions are to have an equal frontage on the said Cockpit Road, the two Western lots to be divided between the said Mary Elizabeth Ann Clouston and Emma Cole Eales Davidson in such manner as they may agree upon.

Fourth. I give and bequeath to the following parties the following sums of money that is to say-To Jessie A. Lester Twenty dollars-To Jessie J. Eales Twenty five dollars. To Fanny Cowen Twenty dollars. To Emma C. Davidson twenty five dollars. To Elizabeth Jolliffe twenty dollars. To Ollie Jolliffe ten dollars. To Emeline Jolliffe ten dollars. To Marjorie Jolliffe ten dollars. To Louisa Dunn eighty dollars. To Ashton Jolliffe Thirty dollars. To Emma E.Scott, one hundred dollars. To Grace Sparks ten dollars. To Grace Murphy ten dollars. To Berthe Halladay ten dollars. To Isabel Dunn ten dollars. To Jack Dunn ten dollars. To the three children of Emma Davidson ten dollars each. To Mrs. Mary Lester twenty dollars. To Mrs. Fanny Lester twenty dollars. To Mrs. Sarah Ann Eales twenty dollars to Mrs. Mary Emma Lester twenty dollars. To the Dorcas Society St. John's twenty dollars. To the Congregational Church, St. John's twenty five dollars. To the Presbyterian House Mission Fund St. John's twenty dollars to Henry Lester, British Columbia, twenty five dollars. All the rest residue and the remainder of my estate and effects of whatsoever nature and wheresoever situate I give and bequeath to the said James Lester. In witness whereof I have hereunto subscribed my hand at St. John's aforesaid this twenty eighth day of February AD one thousand nine hundred and thirteen Jessie Ayre. Signed published and declared by the said Jessie Ayre as and for her last Will and Testament in the presence of us who present at the same time in her presence and in the presence of each other, at her request have hereunto subscribed our names as witnesses, the words "to the three children of Alexander Mearne [Scotland] twenty dollars each" on the 17, 18, and 19, lines on the second page and the words "to the eight children of Charles Lester ten dollars each" on the 20th, and 21st, lines of said page having first been stricken out. This is a Codicil to my last will and testament dated the twenty eighth day of February A D one thousand nine hundred and thirteen. I hereby appoint Walter Clouston of St. John's in the Island of Newfoundland. Commission Merchant, as sole executor of this my Codicile to my last will and testament my aforesaid executor James Lester having departed this life on or about the fourth day of January last. In all other respects I confirm my said last will and testament. In witness whereof I have hereunto subscribed my hand at St. John's aforesaid this twentieth day of December in the year of our Lord one thousand nine hundred and sixteen. Jessie Eales Ayre. Signed by the said Jessie Ayre as and for a Codicile to her within will in our presence who in her presence and in presence of each other have hereunto subscribed our names as witnesses. Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation and also no paragraphs. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be. However, in some of the very long wills, we have tried to insert paragraphs to make it easier for the researcher to read the document.
