Will of Samuel H. Austin from Newfoundland will books volume 7 page 350-351 probate year 1904

The last will of Samuel H. Austin late of
St. John's, Tidewaiter, deceased
.

          This is the last will and Testament of me Samuel H. Austin of Saint John's Newfoundland Tidewaiter. I hereby make and annul all former wills made by me

  1. I give devise and bequeath unto my daughter Ann Sarah Gardner Austin the house at present in my occupancy situate upon the Forest Road also the land with dwelling house and stables thereon belonging to me on the north side of Quidi Vidi Road and bounded as follows on the north by Quidi Vidi Pond on the south by the said Road on the east by land belonging to Samuel Diamond and on the west by land of Michael Connors together with the land in my possession opposite the same upon the southside of the said Road and also the land and field owned by me on the south side of the said Road and adjoining the land of one Michael Connors and further the amount of insurance upon my life in the Masonic Insurance Scheme on condition that she pay out of my said insurance moneys the sum of eighty dollars to my wife.
  2. And I give and devise to my wife Elizabeth Austin and my son Samuel Albert John Austin the dwelling house belonging to me situate on Duckworth Street.
  3. I direct that the expenses of my burial be borne from the money paid at my death from the funds of the British Society.
  4. I give the rest residue and remainder of my estate and effects to my daughter Anne Sarah Gardner Austin and my wife to be divided equally between them. And I hereby appoint Thomas Coffin of St. John's aforesaid Tidewaiter to be the executor of this my will.

In witness whereof I have hereunto subscribed my hand at St. John's aforesaid this first day of September A.D. 1892 and declare the same to be my last will and Testament. Samuel H. Austin. Signed published and declared by the said Testator in our presence who in his presence and at his request and in the presence of each other do hereby subscribe as witnesses (the words "Anne Sarah Gardner" having been subscribed for "Elizabeth" in the seventh line of page one and on the third line of page two and the word Elizabeth having been substituted for in paragraph 2. G. Waring Hayward William H. Horwood.

          I certify the foregoing to be a correct copy of the last will of Samuel H. Austin
