Arthur George Ashbourne
This is the last will and testament of me Arthur George Ashbourne, of the town of Twillingate, in the Island of Newfoundland, Merchant, made this First day of January 1932.
- I hereby appoint my son Harry Frederick Stafford Ashbourne and my nephew Thomas Gordon W. Ashbourne (and in the event of the death of either of the aforesaid) my friend Norman Gray to be the executors of this my will.
- I direct that all my just debts, funeral and testamentary expenses be paid as soon after my death as may be convenient.
- I give devise and bequeath unto my son William Douglas Ashbourne my watch, ring, Cufflinks, studs, one jubilee sovereign and one two dollar gold coin of the Island of Newfoundland same to be given him when he is old enough to appreciate and take care of those several items
- I bequeath to my four sisters Lavina Hodder, wife of John Hodder, Anastasia Grimes (wife of Peter Grimes) Laura LeDrew (wife of Dr. I.B. LeDrew) and Mary Lucy Pander Scaviour wife of Wm. Scaviour, if they are alive at the time of my decease the sum of Two hundred dollars $2000.00
- Having made provision for my daughter Louisa Baird Ashbourne by life insurance payable to her I make no further bequests to her in her own right under this will.
- Having made only a small provision for my daughter Edna McLean Gray I hereby order that a further sum of Two thousand $2000.00 dollars be paid to her by my estate.
- I hereby appoint my wife Margaret Syme Ashbourne guardian of my children, Edna, Louisa and Wm. Douglas, and any other child or children that may be born to me by her before or after my decease.
- I hereby appoint my friend Norman Gray (brother of my wife Custodian of the funds left as legacies to my children, with the power to invest such funds in any reliable Bonds or stocks considered by law as a safe investment for such funds (but on no account must funds be invested in any commercial or speculative venture) and all interest accruing from the investment to be added to the principal sum and the total amount paid to them when they become of age (21 years) It is to be understood however that if any money other than that provided for in other clauses of this will be needed for the support and education of these children that the Custodian of the funds shall use any part of the legacies deemed necessary for these purposes, as it is my wish that my children shall have a liberal education.
- In the event of any child or children being born to me after the making of this will - I hereby authorize my executors to pay over to my friend Norman Gray Two thousand dollars for each child not before mentioned by name and to be invested in the
same manner as provided for in the case of my other children mentioned in clause 8.
- I bequeath to my son Harry Frederick Stafford, in addition to the life insurance payable to him at my death, forty per cent (40%) of all shares owned by me in the commercial business of Ashbourne's Limited, together with all dividends payable on those shares while they remain unsold, and in the event of the sale of said shares, the value of same to be his personal property to be used by him for his personal use and benefit but it is my wish that he pay out of the income from said shares the sum of fifty dollars ($50.00) annually to the Wardens of St. Andrews Church to be used by them for the benefit of the Church in any way they may deem best.
- I have made certain provision for my wife Margaret Syme McLean Ashbourne by life insurance payable to her at my death.
- I do hereby authorize my executors to collect and pay to my wife Margaret Syme McLean Ashbourne yearly all dividends accruing from Sixty per cent (60%) of my shares in the Commercial business of Ashbournes Ltd. While they remain unsold or in the event of said shares being sold, then the interest from the sale price when invested, to be used by her for the maintenance and support of my daughters, and son Wm. Douglas or any other children that may be born to me, and the amount accruing from dividends or from the interest from the proceeds of such sale to be augmented by the interest on any cash residue of my estate not used to pay bequests named in this will.
- I bequeath to my Grand Children the sum of one hundred dollars each and to my nephews & nieces the sum of Twenty Dollars each and to the Memorial Hospital Twenty dollars yearly while my estate holds shares in the business of Ashbourne's Ltd. this money to be used for the upkeep of the Florence Ashbourne Memorial Room.
- I leave my house furniture, land and all other property not before specified for the use of my wife and daughters and my son Wm. Douglas so long as they decide to occupy it, but in the event of my wife and family making a permanent home elsewhere the said house to become the property of my son Wm. Douglas Ashbourne together with the land & outhouses surrounding it, and the garden near the Arm Academy and the piece of ground not fenced and known as the gravel pit - and a fifty per cent interest in the cellar and stable. The balance of all lands owned by me which includes the ground on which his house is built the ground on the hill near Lewis Reids and the large garden near Wm. Oake's and known as the big garden and the garden adjoining the land of George Ing's to the west of his property and a fifty per cent interest in the cellar and stable I leave to my son Harry Frederick Ashbourne with the understanding that if either of my sons die before they become possessed of the said house or lands, then the said houses or lands to belong to the male children of the deceased son, or in the event of no male issue then the total property consisting of houses lands outhouses are to belong to the surviving son or his male heirs.
- After the marriage or death of my said wife and after the marriage or death of my daughters any monies belonging to my estate not used for their maintenance and education is to become the property of my son Wm. Douglas Ashbourne, if living, or if dead said monies to be equally divided amongst the living sons and daughters of my family, and the children of any of my deceased sons and daughters.
It is understood however that in the event of either of my daughters remaining single that said daughters shall be supported by my estate and my executors are hereby authorized to use their discretion regarding this and any other matters that may occur from time to time that except be provided for by me in this my will.
- In the event of my wife marrying again I do authorize my executors to pay her three thousand $3000.00 from my estate this to be in addition to the life insurance left her in her own right and payable at my death.
